Allergic rhinitis decisions — 2024

The Veteran's claims for service connection for left ear hearing loss and fibromyalgia have been denied. The Veteran has been granted a 50% rating for migraine headaches, effective August 1, 2014, with no higher ratings allowed.

The Veteran's service-connected tension headaches and migraines with aura are granted an initial 50 percent evaluation, effective from September 1, 2012. The Veteran's service-connected vasomotor rhinitis is not rated higher than the current noncompensable evaluation.

The Veteran's appeal was denied for an earlier effective date of service connection. The initial ratings assigned for various disabilities were also denied.

The Board has denied the Veteran's claim for service connection for a right ankle disorder due to insufficient evidence showing that his current condition is related to his active military service.,The Board has also remanded the Veteran's claims for service connection for bilateral foot disorder, PTSD, OSA, sinusitis, and rhinitis. These issues are pending further examination and/or medical opinion.

The Veteran's service connection claim for chronic sinusitis and allergic rhinitis is granted. The claims for kidney cancer, hypertension, CHF, and chronic headaches are remanded.

The Board denied service connection for obstructive sleep apnea, but remanded the issues of hypertension, allergic rhinitis, and tinea versicolor.,Further development is needed to determine the onset dates of these conditions.

The Veteran's claims for various conditions, including tension headaches, allergic rhinitis, asthma with histoplasmosis, cervical spine degenerative arthritis, lumbar spine degenerative arthritis, and left knee patellofemoral syndrome were denied. The Veteran was not granted higher ratings or initial compensable ratings for several of her conditions.

The Board denied service connection for respiratory insufficiency other than allergic rhinitis/chronic sinusitis, finding that the Veteran does not have a current diagnosis of this condition and has not had one at any time during the pendency of the claim or recent to the filing of the claim.

The Board has denied the Veteran's petition to reopen her previously denied claim for service connection for a respiratory disability, and has remanded several other claims. The decision is final as it pertains only to the denial of the lung disability claim.

The Board has remanded the case to refer the issue of TDIU prior to June 22, 2012 for extraschedular consideration. The Veteran's service-connected disabilities do not meet schedular requirements for TDIU but may warrant referral for extraschedular review.

The Veteran's appeals for increased ratings on several service-connected conditions have been dismissed. The Veteran withdrew her appeal of the denial of higher ratings for right knee limited motion, left knee limited motion, right knee instability, for a scar of the right knee, and for allergic rhinitis.,Her request for an effective date earlier than February 26, 2020 for the 10 percent rating previously assigned for allergic rhinitis was also dismissed. The Veteran's appeal for increased PTSD to 70 percent has been granted.

The Veteran's TDIU claim is denied because he was not rendered unemployable due to only one service-connected disability, but rather multiple disabilities including his neck and back pain.

The Veteran's claims for bilateral hearing loss and tinnitus were reopened due to the submission of new and material evidence. Service connection was granted for both conditions.,For allergic rhinitis, a noncompensable rating was initially assigned in September 2014. The Veteran requested an increased rating, which resulted in a 10 percent rating effective March 31, 2014.

The Board has remanded the case due to errors in the previous decision and needs further examination for sleep apnea and allergic rhinitis.

The Board dismissed the issue of service connection for allergic rhinitis. The claim for service connection for a back disability was reopened, but the appeal remains pending as it is remanded for additional development. The claims for service connection for a headache disability, cervical radiculopathy (right and left upper extremities), and a left knee disability are also remanded.

The claim for Vitamin D deficiency has been dismissed. The low back disability is granted and rated at 10%. Other issues are remanded.,Neck, rheumatoid arthritis, acquired psychiatric disorder (including dysthymic disorder and insomnia), allergic rhinitis, loss of sense of smell, and sinusitis for increased rating are all remanded.

The Board has remanded the case for further development to determine whether service connection for a respiratory disability on a direct basis is warranted. If so, the Veteran would be entitled to an earlier effective date than August 10, 2022, for the grant of service connection.

The Board has granted service connection for allergic rhinitis and denied service connection for a lung disability. The decision on the lung disability is based on the lack of current functional impairment.

The Board has remanded the claims for service connection for IBS, memory loss, allergic rhinitis, a respiratory condition, and a low back condition due to potential TERA exposure during the Veteran's Gulf War service.

The Veteran's claim for an increased rating for his service-connected left foot disability was dismissed as the Veteran withdrew his appeal.,Service connection is granted for bilateral tinnitus, with no current diagnosis of allergic rhinitis or blepharitis.
