Allergic rhinitis decisions — 2025

The Board remands the case to adjudicate an earlier effective date for the grant of service connection for allergic rhinitis, as this issue is inextricably intertwined with the higher initial rating claim.

The Board granted a disability evaluation of 30 percent for the Veteran's headaches, but denied service connection for lumbar spine, right hip, and right lower extremity nerve disabilities. The claims for PTSD, allergic rhinitis, sinusitis, tinnitus, and hearing loss were remanded.

The Board denied service connection for chronic headaches, to include migraines, and chronic rhinitis, as well as a compensable disability rating for sinusitis and bilateral hearing loss.

The Board granted service connection for chronic sinusitis and rhinitis with an effective date of August 10, 2022.

The Board denied service connection for multiple conditions, including headaches, tinnitus, cervical degenerative disc disease, obstructive sleep apnea, and others, as there was no evidence of an in-service incurrence or aggravation of a disease or injury relating to these disabilities.

The Board granted service connection for chronic sinusitis, allergic rhinitis, chronic bronchitis, and asthma, finding that these conditions are causally related to the Veteran's military service.

The Board denied service connection for bilateral hearing loss and denied increased ratings for allergic rhinitis, sarcoidosis, and residual scars status post basal cell carcinoma. Service connection was granted for chronic sinusitis.

The Board granted service connection for a right shoulder condition, bilateral toenail fungus and athlete's foot, pseudofolliculitis barbae, and furuncle incision and drainage healed scar (claimed as cyst removal on buttocks with scar), but denied an increased rating in excess of 50 percent for sleep apnea with asthma associated with allergic rhinitis. The claims for service connection for prostate cancer and gum disease were remanded.

The Board granted a 30 percent disability rating for allergic rhinitis and remanded the claims for sleep apnea, chronic sinusitis, and irritable bowel syndrome (IBS) for further development.

The Board remands the claim for a disability rating in excess of noncompensable for rhinitis due to an unfulfilled duty to assist, specifically the failure to provide adequate notice and obtain a medical opinion regarding the Veteran's condition.

The Board denied the Veteran's claim for a total disability rating based on individual unemployability due to service-connected disabilities prior to January 31, 2011, as his service-connected conditions did not prevent him from securing or following a substantially gainful occupation.
