Allergic rhinitis Board decisions

The Board has granted effective dates of March 17, 2022 for service connection of sinusitis and chronic allergic rhinitis based on a presumption established by the PACT Act.

The Veteran's claim for a total disability evaluation based upon individual unemployability (TDIU) from January 18, 2017, forward was denied as his service-connected disabilities alone are not of sufficient severity to produce unemployability.

The Veteran's claim for service connection for emphysema is dismissed as the benefit requested has been granted.,The Veteran's allergic rhinitis claim was denied, with no compensable rating assigned.

The Veteran's claim for a compensable rating for deviated nasal septum is denied as the disability is already contemplated by the current rating for allergic rhinitis.

The Veteran's allergic rhinitis has been granted an increased disability rating of 30 percent, effective from the date of the decision. Service connection for ED secondary to PTSD and left knee strain have also been established.

The Veteran's claims for service connection for rhinitis, sinusitis, hypertension, back disability, left hip disability, right hip disability, left shoulder disability, and right shoulder disability have been denied as there is no evidence of these conditions during or within one year after service. The Board finds that the Veteran did not sustain a disease or injury while on active duty that caused his post-service disabilities.

The Veteran's lumbar spine disability, radiculopathy of the lower extremities, sinusitis, rhinitis, and bilateral plantar fasciitis are granted service connection. The Veteran's BPPV is also granted on a secondary basis to her headaches. Service connection for bladder disability and hip disabilities is remanded.

The Board has granted service connection for rhinitis and sinusitis, finding that the conditions are presumptively related to the Veteran's exposure to fine particulate matter during his service in Southwest Asia during the Persian Gulf War.

The Board denied service connection for a sinus condition, including sinusitis and allergic rhinitis, as there was no evidence of a current disability that began during active service or is related to an in-service injury or disease.

The claim for service connection for a neck disability is dismissed. The increased rating for allergic rhinitis, evaluated as noncompensable prior to September 13, 2020, and as 10 percent thereafter, remains on appeal. The TDIU claim prior to January 13, 2020, is denied.

The Board denied the Veteran's claims for a compensable rating for non-allergic rhinitis and service connection for sinusitis, finding that there was no evidence of chronic sinusitis or qualifying exposure to particulate matter. The Board also noted that the Veteran had already been granted service connection for non-allergic rhinitis.

The appeal for service connection for bilateral hearing loss is dismissed.,Entitlement to a disability evaluation in excess of 10 percent for left foot great toe metatarsal trauma was denied.

The Veteran's appeal is being remanded for additional development to ensure proper consideration of his claims, including a new examination for TBI and post-concussive headaches.

The Board has granted service connection for allergic rhinitis but has remanded the issue of service connection for obstructive sleep apnea due to a lack of medical opinion addressing its secondary nature.

The Veteran's appeal for service connection for allergic rhinitis was denied in a November 2022 rating decision. The Veteran submitted a supplemental claim seeking service connection for allergic rhinitis, and the VA awarded it with a 10% rating effective February 16, 2023. However, this award did not result in past-due benefits to the Veteran as his combined disability rating remained at 90%. Therefore, attorney fees were denied.

The Veteran's limitations in performing activities of daily living are consistent with being unable to sustain himself in the community, warranting Tier 2 benefits under the PCAFC program.

The Veteran's asthma is found to be related to his active service, and he is granted service connection for this condition. The Board also grants a TDIU prior to April 15, 2015 due to the severity of his service-connected disabilities.

The Board has granted service connection for respiratory conditions, including asthma, bronchiectasis, chronic bronchitis, allergic rhinitis, and sinusitis, as they are considered to have been incurred in service.
