Osteoarthritis (degenerative arthritis) decisions — 2025

The Board is remanding the issue of entitlement to a rating in excess of 20 percent for lumbosacral strain with degenerative arthritis for additional development.

The Board denied a TDIU under 38 C.F.R. § 4.16(a) prior to April 17, 2012, and remanded the issue of entitlement to a TDIU on an extraschedular basis under 38 C.F.R. § 4.16(b) prior to April 17, 2012, as well as the effective date for Dependents' Educational Assistance.

The Veteran's left knee flexion and extension disabilities were granted a 30 percent rating from November 19, 2014, while the left knee osteoarthritis was denied an increased rating.

The Board remands the claims for a new VA examination to determine the current level of severity of the Veteran's disabilities.

The Board granted service connection for posttraumatic stress disorder, bipolar disorder, alcohol use disorder, and right knee osteoarthritis secondary to the service-connected left knee arthritis. The claims for anxiety and depression were remanded.

The Board denied service connection for a respiratory condition and an initial compensable rating for bilateral hearing loss. The claims for service connection for various other conditions were remanded.

The Board denied an increased rating for obstructive sleep apnea and remanded several issues including service connection for PTSD, increased ratings for various hip and back conditions.

The appeal for revision of a December 2007 rating decision that denied service connection for a left knee condition was dismissed due to the premature filing of a disagreement with a deferred adjudication. The appeals for CUE in ratings assigned for degenerative arthritis of the left hip, right knee, and left elbow were denied.

The Board denied service connection for multiple conditions, including left and right knee degenerative arthritis and instability, left and right shoulder strain, chronic bronchitis, right ankle ligament strain, degenerative arthritis and mild scoliosis, tremors of the hands, and chronic fatigue syndrome.
