Chronic bronchitis decisions — 2022

The Board has remanded the case due to inadequate medical opinions on the presumption of soundness and aggravation, requiring another addendum opinion from a different examiner.

The Board granted service connection for an acquired respiratory disorder, to include bronchitis, but denied service connection for an arachnoid cyst.

The Veteran's claims for increased ratings for lumbar strain with degenerative joint disease, right ankle condition, and chronic bronchitis with asthma are being remanded due to the need for additional medical examinations.

The Board has determined that there is insufficient evidence to grant service connection for bilateral pes planus and a respiratory disability. The Veteran's claims are being remanded for further development.

The Board denied service connection for various conditions, including right eye disability, bilateral foot condition, back disability, right ankle and knee disabilities, bronchitis, and left wrist carpal tunnel syndrome. The reasons given were lack of evidence linking these conditions to service.

The Veteran's asthma with episodic bronchitis is rated at a 30 percent disability rating prior to November 21, 2011. From November 21, 2011, the rating has been increased to 30 percent.

The Veteran's appeals for an increased rating for pneumoconiosis and entitlement to a total disability rating due to individual unemployability (TDIU) have been withdrawn. The Board has dismissed the appeal as the appellant requested withdrawal of both issues.

The Board has decided to remand the Veteran's claims for service connection and aid and attendance, due to inconclusive evidence regarding his respiratory conditions and need for regular aid and attendance. The case will be returned to VA for further development.
