Knee Board decisions

The Veteran's claims for increased ratings and service connection were denied. The RO provided the Veteran with multiple opportunities to submit evidence, but he failed to appear at scheduled VA examinations.

The Board has remanded the case for further development and clarification of issues related to temporary total evaluations, permanent total evaluations, and concurrent receipt of military retired pay and VA service-connected disability compensation.

The Board has denied the Veteran's claim of service connection for a left knee disability, finding that there is no current diagnosed disability and that any pain reported by the Veteran does not constitute a diagnosable condition.

The Veteran's service-connected bilateral knee patellar tendonitis was also not granted a compensable rating.

The Veteran's appeal is being remanded for additional development, including a VA examination to determine the etiology of his claimed disabilities.

The Veteran's right knee disorder is currently rated at 20 percent, and his left knee strain has been granted service connection as secondary to his service-connected right knee disorder. The Board finds that the evidence supports these determinations.

The Veteran's claim for a total rating based on individual unemployability due to service-connected disabilities is being remanded for additional development of the record, including obtaining updated medical records and scheduling VA examinations.

The Veteran's claims for service connection and initial evaluations of scars, back pain, and right knee/leg disorders were denied as the evidence did not support a finding that these conditions are related to his military service.

The Board found that the award of service connection for degenerative joint disease of the left knee was clearly and unmistakably erroneous due to the Veteran's total left knee replacement, resulting in severance of service connection.

The Veteran's claims for increased ratings and TDIU were denied. The lumbar spine disability was rated at 20 percent, the right knee disability at 20 percent prior to March 5, 2008, and at 40 percent from that date.
