Lung cancer decisions — 2011

The Board has determined that new and material evidence has been presented to reopen the claim for service connection for the cause of the Veteran's death. The appellant argues that exposure to radiation during service may have contributed to the Veteran's lung cancer, which was his cause of death.

The Veteran's appeal for CUE in the April 2010 Board decision denying service connection for bladder cancer and metastatic lung cancer has been withdrawn by his representative.

The Veteran's death was not caused by a disease or injury incurred in service, nor is it presumed to have been caused by exposure to herbicides. The Board found no credible evidence of the Veteran having served in-country Vietnam.

The Board denied service connection for residuals of lung cancer, COPD, and liver hemangioma due to carbon tetrachloride exposure as there was no evidence linking these conditions to the Veteran's military service.
