Radiculopathy & sciatica Board decisions

The Board denied the veteran's claims for service connection and TDIU, finding insufficient evidence to support a reasonable possibility of unemployability due to his only service-connected disability, tinnitus.

The Board denied a disability rating in excess of 40 percent for lumbosacral strain with degenerative arthritis of the spine and IVDS, but granted an earlier effective date of February 1, 2023 for left lower extremity radiculopathy, sciatic nerve.

The Veteran's cervical spine disability was granted a 30 percent rating effective May 10, 2010, and a 60 percent rating from June 4, 2014, to November 3, 2019. The LUE radiculopathy associated with the cervical spine disability was granted a 40 percent rating.

The Veteran was granted a total disability rating based on individual unemployability (TDIU) on an extraschedular basis from December 3, 2014 to October 4, 2021.

The Board granted a disability rating of 10 percent for left and right lower extremity sciatic radiculopathy prior to August 10, 2012 and September 15, 2013 respectively, but denied ratings in excess of 40 percent for the left leg and 20 percent for the right leg on and after those dates.

The Veteran was granted a disability evaluation of 40 percent for degenerative disc disease of the thoracolumbar spine, right sciatic radiculopathy, and left sciatic radiculopathy, as well as TDIU.
