Shoulder Board decisions

The Board granted service connection for cervical strain with degenerative disc disease, right shoulder tendinopathy, and left shoulder condition. The claims for right upper extremity radiculopathy as secondary to a cervical strain were also granted. However, the claim for left upper extremity radiculopathy and gastroesophageal reflux disease were denied.

The veteran's appeal requests were denied as they were not timely filed, and good cause was not shown to extend the time for filing.

The Board granted service connection for dermatophytosis (tinea pedis and onychomycosis of the foot) with a rating of 30 percent, but denied service connection for multiple other conditions including hypokalemia, bilateral pes planus, cervical spine condition, left elbow condition, left foot hallux valgus, left hand condition, left hip condition, right hip condition, pain in left shoulder joint, right elbow condition, right hand condition, left extremity sciatica, right extremity sciatica, right knee condition, stomach issues, headaches, and obstructive sleep apnea.

The Board denied an effective date prior to August 6, 2013, for the grant of service connection for fibromyalgia and denied initial disability ratings in excess of 40 percent for fibromyalgia. However, it granted an initial compensable rating for migraine headaches prior to June 20, 2024.

The Board denied service connection for irritable bowel syndrome and posttraumatic stress disorder, but granted an effective date of February 4, 2024, for a 70 percent evaluation for PTSD.

The Board granted service connection for a right knee condition, left knee condition, and right shoulder condition.

The Board denied service connection for scars residual of dog bite right hand, dermatitis, right shoulder and adhesive/latex skin allergy, infertility, residuals of left ovary dermoid cyst surgery with scars, and complete loss of sense of smell (Phantosmia).

The Board granted service connection for bilateral knee degenerative joint disease and right shoulder DJD, but denied service connection for a compensable rating for scar, right bunionectomy, bilateral hearing loss (BHL), and right radiculopathy.

The appeal for increased disability ratings for left shoulder and right ankle disabilities was dismissed due to erroneous docketing in the AMA system.

The Board granted service connection for a cervical spine disability, left shoulder disability, and right shoulder disability based on the evidence showing that these conditions began during active service or are otherwise related to an in-service training incident.

The Board remands the claim for service connection for a right shoulder disorder to verify the Veteran's duty status and obtain additional medical evidence.

The Board granted service connection for left and right knee disabilities but denied service connection for a right shoulder disability, left shoulder disability (secondary to right shoulder), right hand disability (secondary to right shoulder), and right ear hearing loss. The Board also remanded claims for an initial rating higher than 70 percent for PTSD and service connection for left hip, right hip, and right foot disabilities.

The Board granted service connection for a left shoulder strain, cervical strain, and deviated septum but denied increased ratings for the right index finger conditions.

The Board denied a rating in excess of 50 percent for PTSD and a compensable rating for pseudofolliculitis barbae (PFB), but granted service connection for left sciatic radicular pain and paresthesia, right sciatic radicular pain and paresthesia, and right shoulder pain.

The Board remands the claim for service connection for a right shoulder disability due to an inadequate VA medical opinion.

The Board remands the claim for a non-initial disability rating in excess of 20 percent for right shoulder impingement syndrome and rotator cuff tendonitis with bicipital tendon tendonitis/tear, status post arthroscopy due to outstanding private treatment records.

The Board granted an effective date of September 21, 2022, for the Veteran's 100 percent rating for major depressive disorder (MDD), 30 percent rating for irritable bowel syndrome (IBS), and 30 percent rating for a right shoulder disability.

The veteran withdrew the appeal for all service connection and increased rating claims, including those related to various conditions such as right foot condition, TMJ, asthma, jawbone condition, sleep apnea, kidney stones, chronic bronchitis, Alpha gal, encephalopathy, left shoulder, left ankle, cervical spine, right hip, tachycardia, loose teeth, and jawbone condition.

The Board granted service connection for major depressive disorder and anxiety, but dismissed the claims for a rating in excess of 10 percent for a right thumb disorder, a compensable rating for a right thumb scar, a rating in excess of 10 percent for a right thumb scar, and a left great toe disorder as moot. The claims for service connection for a left hip disorder, a right shoulder disorder, and PTSD were remanded.
