Sinusitis decisions — 2021

The Board has granted service connection for erectile dysfunction and a non-compensable rating for sinusitis. The Veteran's claim for an increased rating for lumbar spine DDD, as well as the inextricably intertwined claim for a separate rating for painful bowel function related to his low back condition, is remanded.

The Board has determined that the Veteran's claims for service connection are remanded due to insufficient evidence and need further development.

The Board has granted service connection for migraine headaches. The issues of service connection for gastroesophageal disease (GERD), upper back and cervical spine disability, and sinusitis and rhinitis are remanded.

The Board has remanded the case for further development, including obtaining updated VA treatment records and scheduling a new VA examination to assess the Veteran's current severity of his rhinitis and any associated respiratory conditions.

The Board found that the Veteran did not meet the percentage requirements for a TDIU under 38 C.F.R. § 4.16(a), but referred the case to the Director of Compensation Service for consideration of an extra-schedular rating due to service-connected disabilities.

The Board has granted service connection for a left foot disorder, right foot disorder, and left knee disorder. The Veteran's sinusitis is also considered to have been incurred during her periods of active duty.

The Board has remanded the case due to insufficient evidence regarding the Veteran's respiratory disability, sinusitis, and vasomotor rhinitis. The VA examiner is requested to provide an opinion on whether these conditions are related to active duty service.

The Veteran's claims for sinusitis, GERD, and DJD of the lumbar and thoracic spine were denied. The claim for service connection for tinnitus was granted. A TDIU from September 3, 2013 to November 13, 2019 was granted, but the claim is moot after that date.

The Board has not fully addressed the Veteran's maxillary mucous retention cyst and its relationship to her sinusitis, so the case is being remanded for further evaluation.

The Veteran was granted a TDIU from October 4, 2005 through April 18, 2007 due to his service-connected disabilities.

The Board has found that additional development is needed for the issues on appeal, including obtaining outstanding records and scheduling VA examinations. The Veteran's service-connected conditions of sinusitis, major depressive disorder, chondromalacia patella, right knee, and chronic lumbosacral strain/sprain are still under review.

The Board has determined that the Veteran does not have a diagnosed sinus condition that originated in service or is otherwise etiologically related to his active service. Therefore, the claim for service connection for a sinus condition is denied.

The Board has remanded the claims of service connection for left shoulder disability, right shoulder disability, sinusitis, and headaches due to lack of compliance with previous remand directives. The Veteran is asked to provide any relevant treatment records.

The Veteran's claim for an increased rating for bilateral hearing loss was denied, but his service connection claim for chronic allergic rhinitis (claimed as sinus condition) was granted.
