Sinusitis decisions — 2025

The Board remands the claim for a refund of a VA funding fee to obtain additional records and readjudicate the decision with consideration that the Veteran was still on active duty and receiving service pay at the time of the closing of his home loan.

The Board granted service connection for generalized anxiety disorder, persistent depressive disorder, sinusitis, and tinnitus. A 10 percent rating was granted for chronic headaches from December 22, 2021.

The Board granted a 30 percent initial disability rating for chronic sinusitis and denied service connection for several other conditions, including right knee strain, obesity, degenerative arthritis, and others. Some claims were remanded for further consideration.

The Board denied the veteran's claims for service connection and an increased rating, finding that the evidence did not support a diagnosis of any of the claimed conditions or establish a link between those conditions and his military service.

The Board granted an earlier effective date of May 21, 2013, for the grant of service connection for sinusitis and a 10 percent rating since March 28, 2016.

The Board denied service connection for chronic rhinitis as the evidence did not support a finding that it began during active service or was related to an in-service injury, event, or disease.

The Board granted service connection for acute sinusitis, finding that the Veteran's condition is related to his in-service instances of sinus trouble and military exposures.

The Board granted a 70 percent rating for post-traumatic stress disorder (PTSD) and denied service connection for various other conditions, including cluster headaches, traumatic brain injury, allergic rhinitis, and others. Some claims were remanded.

The Board denied service connection for sinusitis, vertigo/disbalance, and a thyroid disorder but remanded claims for allergic rhinitis, left tonsil cancer, headache disorder, pulmonary granulomatosis, and dysphagia.

The Veteran's PTSD with depressive disorder was granted an increased rating of 70 percent, but no higher, from December 31, 2019. Other claims were denied.

The Veteran's migraine headaches are granted a 50 percent rating, while the claims for increased ratings for major depressive disorder with unspecified anxiety disorder, allergic rhinitis, lumbosacral strain, and left knee patellofemoral syndrome were denied. A separate 10 percent rating was granted from June 17, 2020, for slight left knee instability, and a total disability rating based on individual unemployability (TDIU) was also denied.

The Board granted service connection for chronic fatigue syndrome, a respiratory condition, chronic headaches, allergic rhinitis, chronic sinusitis, and a left knee condition. It also granted increased ratings for nephrolithiasis (kidney stones), right upper extremity radiculopathy, left upper extremity radiculopathy, left lower extremity restless leg syndrome, right lower extremity restless leg syndrome, and lumbosacral strain with degenerative arthritis.

The Board granted an initial rating of 10 percent for sinusitis based on the evidence showing three to six non-incapacitating episodes per year characterized by headaches, pain, and purulent discharge or crusting.

The Veteran withdrew his appeal for service connection for chronic sinusitis and allergic rhinitis, and the Board has no jurisdiction to review these issues.

The appeal of entitlement to service connection for sinusitis was dismissed due to a procedural defect, as the Notice of Disagreement was submitted more than one year after the initial denial and no good cause was shown.

The Board denied an increased rating for allergic rhinitis and an earlier effective date for the grant of a 30 percent rating, as well as an earlier effective date for TDIU and DEA.

The Board granted service connection for chronic sinusitis, obstructive sleep apnea as due to herein service-connected chronic sinusitis, and irritable bowel syndrome. It also granted increased ratings of 20 percent for the left knee disability and 30 percent for the right knee disability.

The Board dismissed the appeals regarding the propriety of proposed reductions in evaluations for lumbosacral strain and rhinitis, as well as denied a compensable rating for sinusitis.

The Board granted service connection for sinusitis and left and right upper extremity radicular pain and paresthesia, but remanded the claims for increased ratings for shoulder disabilities.

The appeal was withdrawn by the Veteran's authorized representative before the Board promulgated a decision.
