Traumatic brain injury (TBI) decisions — 2017

The Veteran's service-connected TBI residuals were rated at 10 percent prior to October 23, 2008 and at 70 percent from that date. The maximum schedular rating for the period prior to October 23, 2008 was 10 percent.

The Veteran's TBI residuals and ocular migraine headaches have been rated based on their severity, with the highest rating of 50% for the period from February 27, 2012.

The Veteran's claim for an increased rating and earlier effective date for service connection for residuals of a traumatic brain injury is being remanded due to the need for additional examination and development.

The Board has found that further evidentiary development is needed, including a VA examination to address the Veteran's claimed TBI and tinnitus disorders. The case will be remanded for this purpose.

The Veteran's service-connected PTSD is currently rated at 30 percent, but the Board has determined that a higher rating of 70 percent is warranted based on the severity and impact of his symptoms.

The Veteran does not have residuals of a traumatic brain injury and the Board finds that service connection for this condition is denied.

The Veteran's service-connected residuals of traumatic brain injury are currently rated as 10 percent disabling, effective December 15, 2010. The VA examiner found that the Veteran has mild headaches and dizziness due to his TBI, which do not affect his ability to work or daily activities significantly.
