Traumatic brain injury (TBI) decisions — 2025

The veteran's appeal for an earlier effective date for PTSD with TBI was withdrawn. The appeals for earlier effective dates for cervical and lumbar spine conditions were denied, but the Board remanded the revision of the March 2010 rating decision based on CUE.

Service connection for traumatic brain injury (TBI) and mid and lower back thoracolumbar spine is denied. Service connection for migraines and a rating more than 10 percent for degenerative arthritis cervical spine, spinal stenosis and IVDS are remanded.

The veteran's claims for service connection for a low back disability and residuals of TBI were granted based on new evidence. The claim for an acquired psychiatric disorder was remanded.

The veteran's request for an earlier effective date and higher rating was denied, but they were granted TDIU and SMC at the housebound rate.

The Board denied an initial compensable rating for TBI and a higher rating for right eye disability.

The veteran's claim for service connection for seborrheic dermatitis was granted, but claims for GERD, traumatic brain injury (TBI), and a higher rating for PTSD were denied.

The veteran was granted special monthly compensation (SMC) based on aid and attendance. However, the requests for increased ratings for migraine headaches due to traumatic brain injury and for traumatic brain injury itself were denied.
