The Board granted service connection for obstructive sleep apnea (OSA) and restored a 40 percent rating for the Veteran's lumbar spine disability effective October 25, 2022.
The deciding factor: The evidence is persuasively weighted towards finding that the Veteran's OSA is proximately due to service-connected chronic sinusitis and/or allergic rhinitis. The lumbar spine experienced forward flexion limited to 42 degrees prior to March 15, 2021; but not limited to 30 degrees or less with consideration of functional loss during flare-ups and after repeated use or favorable ankylosis.
