The Board denied an initial rating in excess of 50 percent for obstructive sleep apnea and asthma, as the evidence did not support a higher rating based on pulmonary function tests (PFTs) or other symptoms.
The deciding factor: The evidence failed to show chronic respiratory failure with carbon dioxide retention or cor pulmonale, or the requirement of a tracheostomy for the sleep apnea. For asthma, PFT results did not meet the criteria for a higher rating under Diagnostic Code 6602.
