The Board denied an initial rating in excess of 20 percent for right and left upper extremity radiculopathy as the evidence did not support moderate incomplete paralysis.
The deciding factor: The VA examination reports showed that while the Veteran had bilateral moderate intermittent pain, he did not have constant pain or other symptoms indicative of moderate neurological impairment. The findings were normal bilaterally with no motor or reflex deficits.
