The Board denied a rating higher than 40 percent for the Veteran's fracture of the L1 transverse process with degenerative arthritis and also denied a total disability rating based on individual unemployability (TDIU).
The deciding factor: The absence of any medical finding of ankylosis or manifestation of unfavorable ankylosis, along with the fact that the Veteran's back stiffness was limited only waking up in the morning, led to the denial of a higher rating for his lumbar spine disability. For TDIU, the Board found that the Veteran's overall occupational and functional impairment is adequately contemplated by his assigned schedular rating.
