GrantedPACT Act
The veteran's claim for an earlier effective date of service connection for hypertension and a right eye condition secondary to hypertension is granted, with the effective date set to April 24, 2014.
The deciding factor: The Board found that the evidence was in relative equipoise as to whether the Veteran's hypertension is causally related to his in-service Agent Orange exposure, and thus the appropriate effective date is the date of receipt of claim or the date entitlement arose, whichever is later.
