Fibromyalgia decisions — 2016

The Board has granted the Veteran's claims for compensation pursuant to 38 U.S.C.A. § 1151 for additional stomach disorder, fibromyalgia and myofascial pain syndrome, and headache disorder as a result of VA medical treatment from statin medications.

The Board has granted the Veteran's petition to reopen his claim for service connection for bilateral hearing loss. The lipomas diagnosed in July 2002 are found to have clearly and unmistakably preexisted service, and thus not incurred during active duty. Service connection is denied for fibromyalgia and lipomas.

The scar from the iliac crest bone graft has also been evaluated.,Service connection for residuals of a skull fracture is denied.

An earlier effective date of July 1, 1995 is granted for service-connected major depressive disorder with PTSD.,The Veteran's freestanding claim seeking an effective date prior to March 15, 2007 for fibromyalgia must be dismissed as a matter of law.

The Veteran's fibromyalgia symptoms have been constant or nearly so since October 27, 2005, and are not controlled by medication.

The Veteran's claims for service connection for various conditions have been denied. The Board found no evidence to support the Veteran's assertions that these conditions are related to his military service.
