Multiple sclerosis decisions — 2024

The Veteran's diagnosed multiple sclerosis is presumed to have been incurred during active service, and the Board granted service connection for this condition.

The Veteran's service-connected disabilities did not preclude him from securing and following a substantially gainful occupation prior to April 2, 2016. From April 2, 2016 to June 27, 2016, the Veteran was in receipt of a total disability rating (TDIU) and Special Monthly Compensation (SMC). The appeal for TDIU is now moot as he is already receiving SMC.

The Veteran's radiculopathy of the right upper extremity with CTS is granted a 30% rating effective November 28, 2016. The Veteran's multiple sclerosis with left eye optic neuritis remains at a 30% rating from that date.

The Board has remanded the cases of bilateral hearing loss, multiple sclerosis, and left ankle disability for further development to verify the Veteran's service periods and obtain medical opinions regarding their etiology.

The Board has decided to remand the case due to insufficient evidence and need for further examination. The Veteran's MS is rated at 30 percent, but she contends it should be higher.
