Shoulder Board decisions

The Board has granted the Veteran's claim for service connection for his right shoulder disability, including degenerative disorders and a total reverse shoulder replacement. The Board found that the current disability is related to an in-service shoulder injury.

The Board has denied service connection for left shoulder disability, mental health disability, and diabetes. The Board found no evidence of a current disability or in-service injury that would support the Veteran's claims.

The Board has granted service connection for major depressive disorder. The claims of service connection for PTSD, bilateral hearing loss, and left shoulder tendinitis with history of recurrent dislocation are remanded due to the need for additional development.

The Board has determined that the Veteran's bilateral shoulder disorder did not have its onset during service and is not otherwise etiologically related to service, thus denying service connection.

The Veteran's appeal of the deferral of a decision for entitlement to service connection for a foot fungal condition is dismissed. Entitlement to service connection for left hand, right hand, migraines, and chronic sinusitis disabilities are granted. Service connection for bilateral hearing loss and left shoulder disability is denied.

The Board has granted the Veteran's claim for special monthly compensation (SMC) based on the regular need for aid and attendance due to his service-connected disabilities, specifically left shoulder strain, closed non-displaced clavicular fracture, and migraines.

The Board has remanded the Veteran's claims for service connection for right and left shoulder disorders due to inadequate etiology opinions in the previous decision. The case will be reviewed with a VA examiner to determine if there is any relationship between the Veteran's current shoulder conditions and his military service.

The Veteran's service connection claims for vertigo, left shoulder disability, GERD, lower back disability, bilateral hip disabilities, and bilateral foot disabilities are denied as there is no evidence of current diagnoses or functional impairment.,The Veteran's service connection claims for erectile dysfunction and radiculopathy of the bilateral lower extremities (right and left) are also denied as there is no evidence of current diagnoses or functional impairment.

The Board has determined that the Veteran is in need of personal care services due to his disabilities, and remands for an evaluation on whether participation in the PCAFC program would be in his best interest.

The Board has decided to remand the claims for additional medical opinions regarding the etiology of various conditions, including cervical spine condition, lumbar spine condition, facial scar, left foot condition, right foot condition, left hip condition, right hip condition, left knee condition, and right shoulder condition.

The Veteran's August 2019 VA Form 9 is acknowledged as a valid notice of disagreement and appeal to the Board regarding his claims for service connection for various conditions, including fatigue, sinusitis, allergic rhinitis, an eye condition, diabetes, left ankle disability, right shoulder disability, and entitlement to TDIU. The issues will be docketed separately.

The Veteran's appeal for higher ratings on several conditions, including migraines, bilateral hearing loss, hemorrhoids, and psychiatric disorder, was denied. The rating for migraine headaches remains at 50 percent, the maximum allowed under current criteria. Ratings for other conditions were also denied.

The Board denied both the extension of temporary total rating for convalescence following a right shoulder surgery and the special monthly compensation at the housebound rate. The Veteran's appeal was not granted.

The Board has determined that new and relevant evidence has been received to reconsider the previously denied claims of service connection for back disability, left hip disability, and bilateral shoulder disabilities. The claims are being remanded for further review.

The Veteran's claim for an increased rating in excess of 20 percent for her service-connected right shoulder impingement syndrome is being remanded due to the inconsistency and lack of clarity in the October 2019 VA examination report.

The Board has remanded the Veteran's claims for additional development due to incomplete records and procedural issues.

The Veteran's service-connected disabilities did not render him unable to obtain and/or maintain substantially gainful employment from January 1, 2017 to May 16, 2018.

The Veteran's claims for increased evaluations of his adhesive capsulitis of the right and left shoulders, as well as his claim for SMC based on need for aid and attendance, are being remanded due to the need for additional medical records.

The Veteran withdrew his appeals regarding right shoulder disability and left upper extremity disabilities, leaving only the TDIU appeal which was also dismissed.

The Board has granted an effective date of September 8, 2013 for the award of a TDIU due to service-connected disabilities. The Veteran's back and left shoulder disabilities have precluded him from securing and following a substantially gainful occupation since that date.
