The Board denied service connection for bilateral hearing loss, chronic fatigue syndrome (CFS), left and right lower extremity restless leg syndrome, sinusitis, and denied an initial disability rating in excess of 20 percent for lumbosacral strain with anterolisthesis and a compensable disability rating for allergic rhinitis.
The deciding factor: The evidence did not show that the Veteran had a hearing loss disability, CFS, or any of the other claimed conditions. For the lumbar spine disability, there was no evidence of ankylosis or forward flexion to 30 degrees or less, and for allergic rhinitis, there was only 50 percent obstruction of the nasal passage on both sides.
